Terms of Service
Effective: 1 August 2026
These Terms of Service govern your use of the Apay wallet, mobile app and website (together, the “Service”). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. Who we are
Apay is operated by Apay Financial Services Ltd (registered in South Sudan). Payment services are offered under partnerships with licensed financial institutions. Regulatory details are published on our Security & Compliance page.
2. Eligibility
- You must be at least 18 years old (or the legal age of majority in your country).
- You must complete identity verification (KYC) before you can send or receive money.
- You must not be on any sanctions list or barred from financial services.
- Business accounts require additional Know-Your-Business (KYB) checks.
3. Your account
- Keep your PIN, biometrics and one-time codes private. You are responsible for actions taken with your credentials.
- Tell us immediately if your device is lost or stolen so we can freeze the wallet.
- We may suspend or close accounts for suspected fraud, sanctions hits, court orders or breach of these terms.
4. Using the service
- Sending and receiving money, paying merchants and cashing in or out through agents.
- Transactions are subject to daily and monthly limits based on your KYC tier.
- Foreign-exchange transactions execute at the rate quoted at the moment of confirmation. Rates change frequently.
- Some services may be unavailable while we perform maintenance or comply with regulatory requests.
5. Fees
Applicable fees are shown before you confirm each transaction and are also published on our Fees Schedule. We may update the schedule from time to time; changes take effect on the date published there.
6. Prohibited use
You must not use Apay for money laundering, terrorism financing, fraud, unlicensed gambling, sale of illegal goods, or any activity that breaches applicable law. See our AML & KYC Policy.
7. Disputes and reversals
If a transaction looks wrong, raise a dispute in-app or through Support. We follow the process in our Complaints Procedure. Not all transactions are reversible — money sent to a verified recipient is generally final.
8. Liability
We provide the Service on an “as available” basis. To the maximum extent permitted by law, Apay is not liable for indirect or consequential loss. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be limited.
9. Changes
We may update these terms. Material changes will be notified in-app at least 14 days before they take effect. Continuing to use Apay after that date means you accept the update.
10. Governing law
These terms are governed by the laws of the Republic of South Sudan. Courts of Juba have exclusive jurisdiction, subject to any mandatory consumer rights that apply where you live.
This page is maintained by Apay to describe current practices and controls. It is not legal advice and is not an independent certification of compliance. Where the text conflicts with a signed customer agreement, the signed agreement governs.
